Tomoya Kimura (the “Operator”) places great importance on protecting the personal information (meaning personal information as defined in Article 2, Paragraph 1 of the Act on the Protection of Personal Information (the “Personal Information Protection Act”); the same applies below) that the Operator handles in connection with AI Live Pro (the “Service”), which the Operator provides. This Privacy Policy sets out the information the Operator obtains in providing the Service, the purposes for which it is used, its provision to third parties, how it is kept secure, and related matters.

1. Information Obtained

The Operator may obtain the following information, to the extent necessary for the purposes of use described below, from Users of the Service (including officers and employees where the User is a corporation), Affiliated Livers (as defined in the Terms of Use; the same applies below), people who make inquiries about the Service, business partners, and others.

Payment information (credit card numbers are obtained by the payment processor; the Operator does not hold them)
Inquiry details

The Operator does not use face images or similar data of Affiliated Livers for face recognition or any other purpose of identifying a specific individual. Data such as facial features generated during processing by the AI Face Swap Feature is handled only temporarily, to the extent necessary for that processing, and is deleted promptly after the processing is complete.

2. Purposes of Use

The Operator uses the information the Operator obtains for the following purposes.

To provide the Service (including converting video with the AI Face Swap Feature)
For identity verification and age verification
To improve the quality of responses to inquiries and to accurately understand the content of inquiries
To bill fees for the Service
To maintain, manage, and improve the systems of the Service
To prevent unauthorized use of the Service and to deal with acts that violate the Terms of Use
To give notice of maintenance of the Service
To announce new features of the Service
To create, use, disclose, or provide statistical data about the Service in a form that does not identify individuals
To create, use, or provide materials for improving and enhancing the Service and for marketing, after processing data so that individuals cannot be identified
For policy proposals and exchanges of views with government agencies and related organizations
For purposes incidental to each of the purposes above

The Operator does not use User Data (including face images and streaming video of Affiliated Livers) for training AI models or for any purpose other than providing the Service without the User’s written consent.

Where a User lets Affiliated Livers use the Service, the Operator may handle the face images and similar data of those Affiliated Livers as personal data entrusted to the Operator by that User. In that case, the Operator handles that personal data only to the extent necessary to perform the entrusted work, in accordance with the Terms of Use and other agreements with the User. Where the User is an individual who live streams themselves, the Operator handles the information as personal information obtained directly from that User, in accordance with this Privacy Policy.

3. Provision to Third Parties

(1) The Operator does not provide personal data to third parties without the prior consent of the person concerned, except in the following cases.

Where required by laws and regulations.
Where necessary to protect a person’s life, body, or property and it is difficult to obtain the User’s consent.
Where especially necessary to improve public health or to promote the sound development of children and it is difficult to obtain the User’s consent.
Where it is necessary to cooperate with a national government agency, a local government, or a person entrusted by either of them in carrying out affairs prescribed by laws and regulations, and obtaining the User’s consent is likely to impede the performance of those affairs.

(2) Exceptions to Third Parties

Notwithstanding the preceding paragraph, in the following cases the recipient of the information is not a third party as referred to in the preceding paragraph.

Where the Operator entrusts all or part of the handling of personal data to the extent necessary to achieve the purposes of use (including entrusting it to cloud service providers and others used for AI face swap processing)
Where personal information is provided in connection with the succession of business due to a merger or other reasons
Where personal information is used jointly with specific parties as follows

(3) Provision to Third Parties in Foreign Countries

The Operator may entrust the handling of personal data to cloud service providers and others located in foreign countries to provide the Service. In that case, the Operator takes the necessary measures in accordance with Article 28 of the Personal Information Protection Act and other applicable laws and regulations.

4. External Services

The Service may work with Streaming Platforms, payment services, cloud services, and other services provided by third parties (“Third-Party Services”).

The handling of information by Third-Party Services is governed by the privacy policies and other rules of their respective providers, so please check each provider’s privacy policy.

5. Cookies and Tracking Technologies

For the purposes of understanding how the Operator’s website and the Service are used, operating, managing, or improving the Operator’s website or the Service, and optimizing advertising provided by the Operator or third parties (including measuring the effectiveness of that advertising), the Operator uses cookies and similar technologies in tools provided by the Operator or third parties (“External Transmission Tools”) to obtain and analyze information about users (advertising identifiers and other information about the device or app used, network information such as IP addresses, and access history; access history includes access logs such as browsing history on advertising pages and on sites linked to the Operator’s services through cookies). Users can control whether cookies are accepted in their browser settings.

For the same purposes, the Operator may also obtain from tool providers, advertising distributors, and other third parties (“External Transmission Tool Providers”) the information about users described above that those providers collected, and the results of their analysis.

6. Measures to Keep Personal Data Secure

The Operator strives to keep the personal data the Operator handles accurate and up to date, and takes necessary and appropriate measures, including training for all employees and security measures for the systems that provide the Service, to protect personal information from alteration, leakage, loss, damage, and unauthorized access.

When a person requests notification of the purposes of use of their personal data, or its disclosure, correction, addition, deletion, suspension of use, erasure, or suspension of provision to third parties (collectively, “Disclosure and Other Actions”), the Operator will respond without delay and to a reasonable extent in accordance with the Personal Information Protection Act. To request Disclosure and Other Actions regarding your personal information, please contact the inquiry contact listed in the Operator Information. A fee set by the Operator (2,000 yen per request) is required for disclosure of personal data and notification of its purposes of use.
